Heard learned counsel for the applicant. By this application, the applicant seeks amendment of the petition, in the light of the fact that the original petitioner has expired during the pendency of the petition. The said petition was filed for issuance of succession certificate. 2.

The original petitioner expired on 15.07.2023 and copy of his death certificate is annexed at Exhibit A to the present application. The applicant is the widow of the original petitioner. It is stated that the original petitioner is survived by the petitioner and a minor daughter. In that light, the proposed amendment is placed at Exhibit 'C' to the present application. Appropriate amendment is sought not only in the cause title, but also in the body of the petition.

In the light of the fact that a copy of death certificate of the original petitioner is placed on record, this Court is inclined to allow the present application.

Accordingly, the application is allowed in terms of prayer clause (a) of the present application. Amendment be carried out within two weeks from today.
