Learned Advocate for the Plaintiff states that the Plaintiff's claim is settled, that he wishes to vacate the order of arrest dated 29th November 2017 and to withdraw the suit. Learned Advocate for the Plaintiff further states that caveat against release [Caveat No. 37 of 2017] of the Defendant has been filed. Advocate for the Caveator is present in Court and states that the Caveator has applied for withdrawal of the above mentioned Caveat No.37 of 2017 and that the same should be considered to be withdrawn.

Learned counsel appearing for the defendant/caveator in Caveat No.37 of 2017 states that the claim made by his client is settled. His client has already made an application for withdrawal of caveat filed by it. He seeks liberty to withdraw the said caveat. Caveat filed by the defendant is allowed to be withdrawn.

In view of the same, the suit is allowed to be withdrawn, the order of arrest is vacated, and the Defendant vessel m.t. F 1 [IMO 9037006] stands released from arrest. Refund of Court Fees as per Rules in favour of the Plaintiff. Poundage payable by the Plaintiff as per Rules. 5.
Instrument of Release is dispensed with. All concerned authorities, Port and Customs to act on a copy of the order duly authenticated as True Copy by the Private Secretary of this Court. The Plaintiff is at liberty to communicate this order by fax/email to all concerned.
