Learned Counsel for the Petitioner confirms that so far payments have been received from the Respondent in accordance with the Memorandum of Understanding between the parties executed for settlement of the Petitioner's debt.

In the premises, there is no occasion to consider the prayer for a provisional Liquidator. The company application is, accordingly, dismissed. However, liberty is reserved unto the Applicant (original Petitioner) to move an appropriate application, if the Respondent defaults in any of the future installments.
