Today when the mater came up for hearing, the petitioner submits that since the hutments are demolished, prayer clause (c ) will not survive now. He prays that this petition may be disposed of by directing respondent no. 4 to decide the petitioner's application Exhibit. D.

In view of the aforesaid, without commenting upon the merits of the matter and the petitioner's entitlement, this petition is disposed of by directing respondent no.4 to consider and take appropriate decision on the petitioner's application Exhibit. D as nilegaonkar 1/2
