Heard Mr.S.V.Bhakre, learned Counsel for the petitioner and Mr.T.R.Yadav, learned Counsel for the respondent. 2.

By this petition under Article 226 of the Constitution of India, the petitioner has prayed for direction to the Vth Labour Court, Mumbai to dispose off the Complaint (ULP)No. 206 of 1997 in a time bound manner. Mr.Bhakre invited my attention to paragraph 18 of the petition and submitted that the complaint was placed before IX th Labour Court, Mumbai as an In-charge Court for hearing / conducting cross examination of respondent's witness-Mr.Uday Ninan. The Complaint was on board on 25/07/2014, 05/08/2014, 02/09/2014, 17/10/2014, 17/11/2014 and 06/12/2014 for cross examination of

-: 2 :- 8.wp.76.15 the said witness. Mr.Uday Ninan did not attend the Court on 02/09/2014, 07/10/2014, 17/11/2014 and consequently, cross examination of the said witness could not be proceeded even on a single date.

Mr.Yadav, upon taking instructions from the instructing Advocate, assures that respondent-Company will extend fullest cooperation for expeditious disposal of the Complaint and will not take undue adjournment.

In view of the assurance, no further orders are necessary. Since the matter is already on board, the petitioner is at liberty to file application for disposing of the Complaint in a time bound manner before the Labour Court. If such application is taken out, the Labour Court will pass appropriate order thereon.

With this, the petition stands disposed of.
