Today when the matter came up for hearing the only prayer made by the learned Counsel for the Petitioner is to dispose of the Petition by directing Respondent No.2 The Assistant Commissioner, P-Ward, Malad, Mumbai to examine the grievance raised by the Petitioner in regard to the illegal constructions raised by Respondent No.5 and to take appropriate decision in accordance with law after giving

opportunity of hearing to the Petitioner as also to the Respondent No.5.

In view of the aforesaid limited prayer we dispose of this Petition with liberty to the Petitioner to submit fresh representation along with the complaint dated 26th April, 2012, 12th June, 2012 and 20th June, 2012 and complaint dated 5th October, 2015 before Respondent No.2 along with the copy of this order within 2 week's time.

The decision as aforesaid be taken by the Competent Authority within 8 weeks from the date of receipt of such representation after giving opportunity of hearing as aforesaid.
