23-WP-187-17.doc Respondent states that the High Power Committee has passed the order dated 3rd October 2009 rejecting the representation of the Petitioner. The learned Counsel appearing for the Petitioner states that the Petitioner is not served with a copy of the said order. The learned AGP states that the order was available on website. We direct the learned AGP to provide a copy of the order to the Petitioner. There is nothing placed on record to show that intimation of passing order was served to the Petitioner.

The learned Counsel appearing for the Petitioner seeks permission to withdraw the Petition with liberty to file an appropriate proceedings for challenging the order of the High Power Committee.

The Writ Petition is disposed of as withdrawn with liberty as prayed.

All contentions on merits are kept open.
