On the basis of the letter dated 14th August 2015 issued by the Mumbai Metropolitan Region Development Authority to the Petitioner, the MMRDA allotted the works which are subject matter of the said letter to the Petitioner on the terms and conditions incorporated in the said letter. The said letter records that the work order relates to the rights to display advertisements on various Foot Over Bridges on Express Highways in Mumbai. The sites subject matter of the said letter are in relation to 7 locations on the Eastern Express Highway and 9 locations on the Western Express Highway, as set out on the second page of the said letter.

The learned Additional Government Pleader on instructions states that the locations which are mentioned in the said letter dated 14th August 2015 (Exhibit-B to the Petition) shall be excluded from the tender process subject matter of this Petition. He states on instructions that if any of the locations subject matter of the said letter dated 14th August 2015 are included in the tender process, the said locations will be excluded from the tender process by following the requisite procedure. We accept the said statements. In view of the said statements, it is not necessary to entertain this Petition and the same is disposed of.
