Mr.Jain, learned counsel appearing for the insolvent tenders an affidavit of the insolvent tendering unconditional apology before this court for remaining absent for some of the meetings before the Official Assignee for his private examination. In the affidavit he has rendered an undertaking to the court that in future he will attend all the meetings before the Official Assignee and will comply with the requisitions. Learned counsel states that the remaining requisitions would be complied with within two weeks from the date. The undertaking rendered by the learned counsel on behalf of the insolvent and rendered in the affidavit are accepted. It is made clear that no further extension would be granted. Inspite of the undertaking if the insolvent does not comply with the requisitions, coercive steps would be taken against the insolvent including under the provisions of the Contempt of Courts Act, 1971. In view of the undertaking rendered by the insolvent, Rule Nisi is discharged.
