1.
The learned counsel for the Petitioner at the outset submits that at this stage he does not press the relief claimed in prayer clauses (a) and (c) and he is restricting this writ petition to the relief claimed in prayer clause (b). We have gone through the same. Under the said prayer clause, the Petitioner has sought investigation by the EoW and/or Crime Branch, CID and/or CBI in respect of the fraud in implementation of the subject slum rehabilitation scheme. Obviously, such writ petition cannot lie on the civil side. Faced with this difficulty, the learned counsel for the Petitioner seeks leave to convert this writ petition into criminal writ petition. Leave granted. The Petitioner shall carry out necessary amendments in the petition patilsr 1 / 2
within two weeks from today. After the amendments are carried out, Registry shall take necessary steps and place the matter before the appropriate bench on criminal appellate side. [SMT. ANUJA PRABHUDESSAI, J.] [RANJIT MORE, J.] patilsr 2 / 2
