This is a suit filed under Section 32-B of the Parsi Marriage and Divorce Act, 1936. The plaintiff nos.1 and 2 have married on 6 th December 2011 at Colaba Agiary, Mumbai. The plaintiff no.2 had earlier filed a suit in this court being Suit No.12 of 2021, which has been withdrawn today since both the plaintiffs have filed the present suit. The plaintiffs have been living separately since 7 th August 2020 and have stated to have severed all matrimonial ties for more than one year before filing the present suit. There is one issue out of the marriage - a male child Armaan, aged 3 years. 2.

signed by the parties. The consent terms are annexed at Exhibit-B to the plaint. They have comprehensively provided for welfare of the minor as well. The plaintiffs are present today in court. They have affirmed the contents of the consent terms. They have also tendered their affidavits-of-evidence and affirmed to the truth of the contents of the affidavits by examination-in-chief. 3.

In view of the fact that the original marriage certificate is annexed to the Counter Claim (Lodging) No.23437 of 2021, requirement of annexing marriage certificate in the present suit is dispensed with. 4.

Accordingly, at the request of the parties and by consent, I pass the following order :- (i) Suit is decreed in terms of prayer clauses (a) and (b). (ii) Undertakings contained in the consent terms are accepted.

(iii) Suit is disposed in the above terms.
