Mr Joshi states that there is an Appeal for Assessment Year 2009-10 which Petitioner has filed before the Commissioner of Income Tax (Appeals) and in that Appeal Revenue has relied upon the order impugned in this Petition. Mr Joshi states that since the stand of Revenue will be tested in the Appeal that is pending, his instructions are not to press ahead with this Petition. 2.
