ORDINARY ORIGINAL CIVIL JURISDICTION CHAMBER SUMMONS (L) NO. 2067 OF 2014 IN SUIT (L) NO. 1049 OF 2014 Ahsan @ Mansur Hasan Khan ...Plaintiff
Versus
Salim Hasan Khan & 4 Ors.
...Defendants Mr. Aditya Khandeparkar, i/b M/s.
ALMT Legal, for the Plaintiff.
Mr. Atul Daga, i/b M/s. Mulla & Mulla, for Defendant No. 1. CORAM: G.S. PATEL, J DATED:
6th January 2015 PC:- 1.
The Chamber Summons seeks amendment of the plaint and the Notice of Motion to delete an inadvertent typographical error. It seems that the word "permanent" has been incorrectly and inadvertently used in prayer clauses (g), (h), (i), (j) and (k); and in the corresponding prayers in the Notice of Motion. This is sought to be corrected. In addition, a formal prayer "kk" is sought to be added to the plaint.
909-CHSL2067-14.DOC 2.
Chamber Summons is made absolute in terms of prayer clauses (a) and (b).
3.
This order is passed entirely without prejudice to the rights and contentions of both the parties. Should the Plaintiff hereafter apply for ad-interim reliefs, it will be open to the Defendants to contend that no ad-interim relief should be granted inter alia on account of previous orders passed.
4.
Time earlier granted by order dated 20th November 2014 for filing of the reply and rejoinder is extended as follows: Affidavit in reply to be filed and served on or before 19th January 2015; Affidavit in rejoinder, if any, to be filed and served on or before 28th January 2015. List the Notice of Motion for hearing and final disposal on 4th February 2015.
