By consent, both the parties agreed to refer their disputes including counterclaim, if any, to arbitration under the provisions of Arbitration and Conciliation Act, 1996 (the said Act).

Therefore, by consent, the following order is passed :- (a) Mr.Mikhail Behl, an Advocate practicing in this Court is appointed as sole Arbitrator to arbitrate on disputes and differences including counterclaim, if any, arising out and/or in connection with and/or relating to the underlying transactions in this petition.

901.cp.110.2015.doc (b) The fees, administrative expenses, typing charges and venue expenses of the Arbitrator shall be shared equally between parties and the same will be costs in the arbitration proceedings.

(c) Within three weeks of receiving a communication from the advocate for petitioner and/or respondent, the Arbitrator shall give in writing, directly to parties disclosure as required under Section 11(8) read with Section 12(1) of the said Act. Company Petition accordingly disposed.

For completion of record, registry to accept the rejoinder being filed by petitioner.
