Rule. Returnable forthwith. Heard finally by consent of parties. 2.

We are inclined to dispose of the present Writ Petition by directing Respondent No.1 to reconsider the case of Respondent No.4 about approval to appointment of Asst.Teacher with the Petitioner-Management. Respondent No.1 while reconsidering the same shall take into consideration the order passed by the School Tribunal dated 3 September 2011 and the decision of this Court in Writ Petition No.767 of 2007 dated 12 December 2012 (by one of us A.A.Sayed, J.).

The Petitioner-Management is permitted to submit all relevant documents including copies of Petition, Reply and Rejoinder to Respondent No.1 within two weeks from today. Respondent No.1 to consider the same in accordance with law and in view of the above observations as early as possible and preferably within four weeks thereafter. 4.

The Petition is disposed of accordingly with liberty. All points kept open. No costs.
