Learned Advocates for the parties state that both these suits have been settled. They have filed common consent terms in these suits, which is dated th April 2021. The original consent terms have been filed in court and have been placed before the court. The signatories who are parties in Suit (Lodging) 1/2 4-COMSL-1079-2019 & COMS-94-2020[5435].doc Dixit
No.1079 of 2019 and Commercial Suit No.94 of 2020, confirm that they have arrived at a settlement and have executed these consent terms. 2.
In view thereof, at the request of the parties and by their consent, I pass the following order :- (i) Consent Terms dated 20 th April 2021 signed by the plaintiff's Secretary, duly authorized by a resolution dated th February 2021, and by the partners of the defendant in Suit (Lodging) No.1079, namely, Mr. Nikhil Gandhi and Mr. Dharmesh Tanna, who are all present on this video conference hearing and are identified by their respective Advocates and all of whom confirm execution of these consent terms, are taken on record and marked "X" for identification.
(ii) There will be a decree in terms of the consent terms. In view of the decree, the suit is disposed as above. (iii) In view of the above, Interim Application (Lodging) No.184 of 2019 stands disposed.
(iv) All interim orders stand vacated.
