Contention is act of respondent No. 1 in registering a tenancy agreement on 16th December 2014 is in violation of orders of Small Causes Court at Bombay passed on Exhibit 30 on 18th November 2013. Learned counsel for petitioner submits that said order was communicated to respondent No. 1 and despite it, the document has been registered.
Learned A.G.P points out that so-called communication at Exhibit `D' dated 2nd December 2013 though addressed to office of SQ Pathan 1/2
wp.947.18.61.doc respondent No. 1 is delivered in entirely different office i.e. Office of Collector, Mumbai City.
It is apparent that if orders of Small Causes Court are violated, it is open to petitioner to approach that Court and point out said violation and seek necessary relief. Hence, keeping contentions of the petitioner open, we dispose of present challenge. REVATI MOHITE DERE, J.
