There are two schedules annexed to the Chamber summons and counsel for the applicant states that amendment is required only so far as schedule-1 is concerned and schedule-2 is annexed by mistake. No reply has been filed though served. This is also a pre trial amendment. Considering the proposed amendment, no new cause of action is being introduced and the proposed amendment also does not change the nature and character of the suit. Since no prayer is being sought in the proposed amendment, the question of any part being barred by limitation does not arise. KJ

chs395.16-34 Chamber summons is allowed in terms of prayer clause- (a) except the portion bracketed in red ink and accordingly disposed. Amendment to be carried out and amended plaint to be served within two weeks. Within two weeks of receiving the amended plaint, defendant to file further written statement.
