The notice of motion seeks recall and setting aside of an order dismissing the suit for want of prosecution. For the reasons stated in the affidavit in support of the notice of motion, the delay is condoned and the notice of motion is made absolute in terms of prayer clause (a), subject to payment of costs quantified at Rs.50,000/- The Plaintiff to pay the costs to the Defendant within a period of two weeks from today.
