By order dated 07.09.2023, this Court had allowed Interim Application (Lodging) No. 36352 of 2022 and consequential amendments were to be carried out. This Court is informed that the amendments were carried out in the prescribed period of time. 2.

Today, this proceeding is listed in the backdrop of settlement of disputes between the parties. Consent terms have been executed between the plaintiff and the legal heirs of the defendant, brought on record. 1/2

It is specifically brought to the notice of this Court that defendant No.1B has executed power of attorney in favour of defendant No.1A, inter alia, for signing the consent terms. Copy of power of attorney is annexed to the consent terms. The copies of aadhar cards of the plaintiff and defendant Nos.1A to 1C are annexed to the consent terms. 4.

The learned counsel appearing for the plaintiff submits that the plaintiff and defendant Nos.1A and 1C are present in Court. The original aadhar cards were produced for verification and upon verification by the Associate of this Court, the original aadhar cards were returned to the parties.

The consent terms are taken on record and marked 'X'. In the light of the consent terms, the suit is decreed. The undertakings given in the consent terms are accepted as undertakings given to this Court. Parties are directed to abide by their respective obligations, as per the consent terms. 6.

A soft copy of the consent terms shall be uploaded as second order in the matter. A hard copy of duly signed consent terms shall be retained in the record and shall not be sent for destruction in the usual course. Court fees shall be refunded as per rules.
