This is a petition seeking leave under Clause XII of the Letters Patent. The petitioner is the sister and the respondent is the brother. The suit is for administration of properties the details of which are set out in paragraph 2 of the plaint. Although the majority immovable and movable properties are at Mumbai within the jurisdiction of this Court, however one property namely property the details of which are set out in paragraph 2(d) stated to be land alongwith structure standing thereon is situated at Amelia, Jaunpur Village, Uttar Pradesh which is out side the jurisdiction of this Court. Perusal of the leave petition as also averments made in the leave petition, it is quite clear that material part of the cause of action has arisen between the parties at Mumbai and with leave of this Court being granted under Clause XII of the Letters Patent, this Court would have jurisdiction to try and entertain this suit. 3.
