This notice of motion is for restoring the suit that came to be dismissed by an order passed on 19.07.2011 by the Prothonotary and Senior Master, High Court Bombay.

I have heard the counsel appearing for the applicant and also perused the affidavit n support. For the reasons mentioned in the affidavit in support, the notice of motion is allowed. The order passed by the Prothonotary and Senior Master dated 19.07.2011 is recalled and the suit is restored to file. From the prayer clause (a) to the plaint, it appears that the claim in the suit is less than Rs.1 crore, the suit. Therefore, be transferred to the Bombay City Civil Court.
