Heard Mr. Kirpekar. There is an ad-interim order dated 29th October 2015. The Defendants approached the Plaintiffs personally but thereafter did not show any interest.

The Leave Petition has been served. For the reasons set out in the Petition, it is made absolute in terms of prayer clause (a). 11th August 2016

There is no reason why the ad-interim order should not be confirmed. There is no Affidavit in Reply.

The ad-interim order is confirmed as the final order on the Notice of Motion and, in addition, there will also be an order in respect of the reliefs in passing off in terms of prayer clause (d). 5.

The Notice of Motion is disposed of in these terms with costs. In addition, the Plaintiffs will also be entitled to recover the actual costs on this Notice of Motion at the time of final hearing of the Suit.
