This Notice of Motion has been filed against the order dated 14th September 2015 passed by this Court in Notice of Motion No.949 of 2014 as void, ab-initio since it is rendered wholly without jurisdiction and in violation of the principles of natural justice. Prayer clause (b) is to recall or review the order passed by this Court. The VRD 1/2
NMS1887.15 grounds on which this order is sought to be challenged are identical to the grounds raised by Defendant No.3 in Notice of Motion No.1981 of 2015. That Notice of Motion has been dismissed by me today. For the reasons set out in my order passed in Notice of Motion No.1981 of 2015, this Notice of Motion is also dismissed. There shall be no order as to costs.
