Petitioner is aggrieved by the notice issued by the Respondent under section 55 of the MRTP Act, asking him to remove the temporary shed which he has constructed over his balcony. It is an admitted position that the Petitioner has not obtained necessary permission from the Corporation.

2/2 WPL/3376/2014 Reserving the right of the Petitioner to seek permission/regularization by filing an application under section 44 of the said Act, Petition is disposed of. The impugned notice may not be acted upon for a period of four weeks.
