Heard the learned Advocates appearing for the parties and the following order is passed by consent :

(i) The order dated 26 th October, 2018 is recalled.

(ii)Hon'ble Mr. Justice D.G.Karnik (Former Judge of this Court) is appointed as nominee Arbitrator of the Petitioner. Hon'ble Mr. Justice D.B.Bhosale (Former Chief Justice of Allahabad High Court and former Judge of this Court) is appointed as nominee Arbitrator of the Respondents. (iii)of Mr. Justice D.G.Karnik and Mr. Justice D.B.Bhosale, shall file their disclosures under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act, 1996 as amended by the Arbitration and Conciliation (Amendment) Act, 2015 (3 of 2016) on or before 21 st November 2018 and they shall also provide a 1/2

ssp 922 CARBPL 1220 OF 2018.doc copy of their respective disclosures to the parties and/or their Advocates. (iv)Both the learned Arbitrators shall appoint the third/presiding Arbitrator.

(v) All contentions of the parties are kept open. (vi) The cost of arbitration shall initially be borne by the parties equally. (vii) The venue of Arbitration shall be at Mumbai. (viii)In view of this order, the above Arbitration Petition is disposed of. ( S.J.KATHAWALLA, J. ) 2/2
