Heard learned counsel for the petitioner and the learned AGP for the respondents.

The grievance of the petitioner is in regard to the order dated 5.12.2017 issued by the Collector, Mumbai Suburban District, in regard to the closure of the liquor and wine shops on 12th, 13th and 14th December, 2017 issued in view of the by-elections of the Municipal Corporation of Greater Mumbai, to be held for Ward No.21. It is apparent that the grievance of the petitioner is identical to the grievance made in the case of Maharashtra Wine Merchants

RNG 2/2 911-wp3486 Association and another vs The Collector of Mumbai Suburban Mumbai and others in Writ Petition (Lodging) No.3467 of 2017 which came to be heard by a Division Bench of this Court on 8th December 2017 of which one of us (G.S.Kulkarni,J) is a member. This petition shall thus stand governed by the order dated 8th December 2017 passed by the Division Bench in Writ Petition (Lodging) No.3467 of 2017.

The parties agree that the petition be disposed of in terms of above order. It is accordingly disposed of. No costs. 4.

All contentions of the parties on the legal issues are kept open.
