Heard Mr Lakhani for the Plaintiff/Petitioner. 2.

The suit is for cancellation of an agreement. Some of the defendants are in Mumbai and others are outside the jurisdiction of this Court. The suit also relates to HUF properties, some elements of which are in Rajasthan. In addition, at least three agreements are said to have been executed in Rajasthan. The suit and the petition state that a material part of cause of action has arisen in Mumbai. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have jurisdiction to try and entertain the suit. Leave granted. The petition is made absolute. No costs.
