The petitioner has not issued any notice for appointment of the learned arbitrator as per provisions of the arbitration agreement after recusal of the learned arbitrator to act as an arbitrator. Learned counsel for the petitioner seeks liberty to withdraw this petition with liberty to issue fresh notice upon the respondents for appointment of the arbitrator and thereafter to file a fresh petition, if the arbitrator is not appointed by consent of the parties. The statement is accepted. 2.

The arbitration petition is allowed to be withdrawn with liberty as prayed. No order as to costs.
