Dr. Birendra Saraf with Mr. Rohan Sawant, Mr. Sanjay Kadam, Mr. Sanjil Kadam, Mr. Deepak Enakphale and Ms.Sayalee Rajpurkar i/b. M/s. Kadam and Co. for respondent no. 1.
CORAM :- S. C. DHARMADHIKARI & B. P. COLABAWALLA, JJ.
DATED :- OCTOBER 6, 2016 P.C. :- 1.
Heard the learned counsel appearing for the petitioner. Perused the order passed by the Division Bench of which contempt is complained of.
2.
Having perused it and in the light of the allegations in the contempt petition, we find that no case of civil contempt is made out. The contempt petition is entirely misconceived and used as a means to obtain substantive relief. It is, therefore, dismissed. (B.P.COLABAWALLA, J.) (S.C.DHARMADHIKARI, J.) J.V.Salunke,PA
