Heard learned Counsel for the parties. The Respondent has already been reporting to duty with effect from 15 October 2015 and is employed with the Petitioner. The petition is disposed of, by consent of the parties, in terms of the following order :

(I) The impugned order of the Third Labour Court, Mumbai dated 3 February 2015 to the extent it directs payment of 50% back wages from the date of termination, i.e. 16/6/2005 is set aside.

(II) Learned Counsel for the Petitioner states that the Petitioner shall pay a sum of Rs.1,25,000/- to the Respondent in full and final settlement of his claim for back wages. The statement is accepted. (III) The Petitioner is directed to make payment of Rs.1,25,000/- to the Respondent within a period of one week from today. This payment shall be in full and final settlement of the Respondent's claim for back wages. (S.C. Gupte, J.)
