The above Official Assignee's report is allowed in terms of prayer clauses (b) and (c), which are reproduced hereunder : "(b) In the alternative to the above, the Official Assignee may be permitted to dispense with the private and public examination of the Insolvent abovenamed and annul his insolvency under Rule 136 of Presidency Towns Insolvency Rules, 1910, while doing so, the Insolvency Registrar may be directed to publish an advertisement about such annulment of Insolvency in the Maharashtra Government Gazette.
Nitin 2 / 2 1075-OAR-15-2014 (c) If the Insolvency Petition No. 161 of 2004 is disposed off, the Official Assignee be permitted to deduct his cost, charges and expenses, etc. from the balance lying to the Estate Account and balance remains, if any, be deposited in the Undivided Claim Account maintained by the Official Assignee."
