The present Chamber Order is taken out for restoration of the Petition, dismissed by Order dated 06.09.2017 under the provision of O.S.Rule 986.

Perused Affidavit in Support. Heard Ld.

Counsel for the Applicant. Ld. Counsel for the Applicant submitted that this Chamber Order is filed by the Applicant for restoration of the Testamentary Petition, which is uncontested, in which office objection was in respect of court fees. Ld. Counsel for the Applicant submitted that Applicant was not able to pay court fees due to financial condition. Therefore, Petition was rejected.

Since matter is uncontested, contention of the Applicant needs to be accepted.

Accordingly, Chamber Order is granted as prayed and signed separately. No order as to costs.
