The Motion is for an amendment to insert averments regarding subsequent events but also to join Defendant No. 18 since he claims to have subsequently acquired rights in the suit property. There is also a proposal to add two prayers seeking declarations. Only some of the Defendants have filed their Written Statements. Issues are not yet framed. The amendment will have to be allowed. 8th January 2019

Amendment to be carried out on or before 28th January 2019. Copies of the amended plaint will be served on the Advocates for the Defendants. Those of the Defendants who have filed their Written Statement will be at liberty to file supplementary Written Statements on or before 4th March 2019. Those who have not filed Written Statements will file their Written Statements to the amended plaint by that date.

The Chamber Summons is made absolute in terms of prayer clause (a) with the correction to the schedule as permitted in Court today.
