The Petition is for leave under Clause XII of the Letters Patent. The Suit is for specific performance of a settlement agreement. The agreement in question is said to have been executed in Mumbai and the obligations were to be performed in Mumbai. The proposed Respondents are all outside Mumbai. A material part of the cause of action has arisen within the jurisdiction of this Court. I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
