This is an application seeking extension of time to file an affidavit of evidence, affidavit of documents and compilation of documents on behalf of the defendant.

By an order dated 14th August, 2019, the defendant was directed to file affidavit of evidence, affidavit of documents and compilation of documents on or before 11th September, 2019. The Court had made it clear that there shall be no extension of time.

It seems that the defendant could not comply with the directions within the stipulated period on account of the illhealth. Hence, this application was preferred on 12th October, 2019.

In view of the situation which arose due to Covid-19 Pandemic, it seems the application has not been listed before the Court since then. In the circumstances, to advance the cause of substantive justice, the application deserves to be allowed.

Hence, the following order.

: O R D E R :

(i) The application stands allowed.

(ii) The defendant shall file affidavit of evidence, affidavit of documents and compilation of documents within a period of six weeks from today and serve its copies on the plaintiff.

(iii) Discovery and inspection shall be completed and statements of admission and denial be exchanged within two weeks thereafter.

Suit be listed on 5th January, 2023.
