The learned counsel appearing for the parties, i.e. Mr.Karan Shroff for the Appellant and Mr. R.V. Pai for the Respondent No.1, who is the main contesting Respondent in the above Appeal, tender Minutes of the Order bearing today's date i.e. 04/10/2017. In paragraph No.2 of the Minutes of Order there is a handwritten portion, as well as paragraph No.6-A is handwritten. The handwriting is that of Mr.R.V. Pai, the learned counsel appearing for the Respondent No.1. Both Mr.R.V. Pai and Mr.Karan Shroff have initialed the handwritten portion. The Minutes of the Order have been signed by the respective advocates on record. On behalf of the Appellant, it is signed by Advocate Mr.Ankur Kalal for Markand Gandhi & Co. and for the Respondent No.1 by Mrs.Bina Pai. The Minutes of the Order have also been signed by the Appellant Mr.Jayendra Jayant Salgonkar and Mr.Jayraj Jayant Salgaonkar, who are also personally present in Court. The learned counsel appearing for the Appellant Mr.Shroff has also tendered an affidavit of Mr.Jayendra Salgaonkar, as mentioned in paragraph No.2 of the Minutes of the Order. The Minutes of the Order are taken on record. The Appeal is accordingly disposed of in terms of Minutes of Order.

In view of the disposal of the Appeal, the Notice of Motion does not survive and to accordingly stand disposed of as such.
