Heard learned Counsel for the parties. After the matter is heard at some length, learned Counsel for the Petitioner submits that he would not press his petition, if the issue raised in the petition is kept open and he is given liberty to agitate the same, in case the final order to be passed by the Competent Authority And District Deputy Registrar Mumbai goes against the Petitioner. The petition is disposed of as not pressed. The subject matter of the petition is kept open and the Petitioner will have liberty to raise the same grounds of challenge, in case the final order of the Competent Authority goes against it. It is also clarified that the Petitioner will be at liberty to request the Competent Pg 1 of 2
wpl3639-17.doc Authority to hold its hands, since the larger issue considered in Writ Petition No.180 of 2018 and Writ Petition (L) No. 3057 of 2017, namely, whether or not conveyance can be granted to a society of a part of a larger layout out is being considered by this Court. It will be considered on its own merits. Office to take on record the vakalatnama to be filed by Respondent No.2.
