Parties have arrived at a settlement. They have tendered consent terms dated th July, 2018. Consent terms are signed by a Director of the Plaintiff and the proprietor of the defendant both of whom are present in Court and confirm having executed consent terms. As provided in the Consent Terms Learned counsel for the

501-coms-181-2015 plaintiff applies for withdrawal of Commercial Suit No. 776 of 2017. In view of the above I pass the following order :

(i) There will be an order in terms of the consent terms. Commercial Summary Suit 181 of 2015 is disposed of in the above terms and the provision made in clause B(1) of the Consent Terms.

(ii) Suit No. 776 of 2017 is allowed to be withdrawn. (iii) In view of the above the Summons for Judgment no. 52 of 2016 and 112 of 2017 do not survive. The same are disposed of. (iv) Refund as per rules.
