Mr. Shirole, counsel for plaintiffs states that writ of summons has been served on defendant no.2 on 10th May 2019 and relies on an affidavit of one Rajkumar J. Tiwari affirmed on 5th October 2019. Therefore, suit as against defendant no.2 be transferred to the list of undefended suits.

So far as defendant no.3 is concerned, Mr. Shirole seeks leave to withdraw the suit as against defendant no.3.
