Perused the orders dated 20.12.2016, 08.02.2017 and 02.05.2017 passed by this Court (Coram : G. S. Patel, J.) in Judge's Order No.126 of 2016 in Testamentary Petition No.2201 of 2016.

Mr. Joshi submits that clauses (a) and (b) of the order dated 20.12.2016 are complied by the petitioner. He further submitted that clauses (a) to (e) of paragraph 6 of the order dated 08.02.2017 are also complied. In paragraph 5 of the order dated 02.05.2017, it was clarified that this Court has not directed RBI to give value for any demonetized currency inventory. JOT126_16.doc Mayank Rawal, Associate of this Court, who is appointed as Commissioner.

Mr. Patil submitted at the time of taking custody of sealed box on 28.04.2017, contents of the sealed box were not known to R.B.I.

It is now agreed between the parties that Mr. Rawal will visit RBI on 05.10.2017 between 11.00 a.m. and 5.00 p.m. to verify the contents of the sealed box. Commissioner will open the box in the presence of RBI Official and Advocate for the petitioner. Officials of RBI shall compare the description of the notes given in the report of the Commissioner with the notes found in the box.

In view thereof, R.B.I will count notes of 500 and 1000 rupees in the presence of the Commissioner and will also note serial number of notes of 500 and 1000 rupees on demonetization. R.B.I after carrying out that exercise, will issue the receipt immediately. Order accordingly. (R. G. KETKAR, J.) Minal Parab 2/2
