The Suit is settled. Consent Terms are tendered. These are signed by the representatives of the parties and their Advocates. The Advocates on both sides confirm that they have the requisite authority to represent their clients.

By the Consent Terms the Defendants have submitted to a decree in terms of prayer clauses (a) and (b). 3.

I am satisfied that Consent Terms are in order and not contrary to law. I am also satisfied that Consent Terms have been drawn by the parties of their own volition and reflect their true 18th October 2016

239-S-356-2016.DOC intentions. The Consent Terms are taken on record and marked "X" for identification. The undertakings in Consent Terms are accepted as undertakings to the Court.

The Suit is disposed of in accordance with the Consent Terms.

Refund of Court Fees, if any, in accordance with the Rules. 6.

Drawn up decree dispensed with.

7.

The Court Receiver is to stand discharged without passing accounts on payment within four weeks by the Plaintiff of his costs, charges and expenses.

8.

In view this, the Notice of Motion does not survive and is disposed of as infructuous.

9.
