1. Heard Mr. Kamdar, learned Advocate for Petitioner and Mr. Dhangar, learned Advocate for Respondents.

2. Perused the order dated 21.11.2022. Paragraph No.4 of the said order reads thus:

"4. The respondent being served, is represented by Mr. Chetan, Mr. Kapadia, who expressed his consensus over taking recourse to the arbitration clause and he also expressed his consensus over appointment of Mr. Naushad Engineer as an arbitrator, with an understanding that the application filed u/s. 9 of the Arbitration and Conciliation Act, 1996 shall be converted into an application u/s.17 to be heard and decided by the learned Arbitrator within a period of eight weeks."

3. Mr. Kamdar would submit that parties were attempting a reconciliation but the settlement talks have failed.

4. Both the learned Advocates have hence jointly prayed for

5. By consent, time stands extended by 8 weeks from today to hear and decide the Section 17 Application.
