Reasons for absence of the advocate for the applicant on 17th October, 2018 have been mentioned in paragraph 4 of the affidavitin-support. In view of the said reasons, a case is made out for restoration of the appeal.

Accordingly, the Notice of Motion is made absolute in terms of prayer clause (a).
