It is not in dispute that after withdrawal of office by the earlier arbitrator Shri Justice S.K. Shah (Retd.), the petitioner has not issued any fresh notice for appointment of arbitrator. Mr.Bharti, learned counsel for the petitioner seeks liberty to withdraw this arbitration petition with liberty to issue a fresh notice for appointment of the arbitrator so as to fill up the said vacancy and to file a fresh petition.

The arbitration petition is dismissed with liberty as prayed. No order as to costs.
