Parties have amicably settled the matter and tendered consent terms dated 6th February 2018. The consent terms signed by petitioner, the Director of respondent-company and their respective advocates is taken on record and marked 'X' for identification. The counsel for petitioner identifies petitioner and counsel for respondent identifies Shri Milind Lavate, Director of respondent who has signed on behalf of respondentcompany. Mr. Lavate undertakes to this Court for himself, on behalf of the other Directors of the company and for the company that the cheque referred to in Paragraph 3(c) of the consent terms will be honoured on presentation. Undertaking accepted. Since it is at pre-admission stage, the petition dismissed with liberty to petitioner to apply for revival of the petition in case, the admitted amount of Rs.11,40,000/- is not paid. On such an application being made, petition will stand admitted and petitioner will be at liberty to advertise the petition.
Company petition disposed accordingly.
Company Application No. 330 of 2017 also stands disposed accordingly.
