After the petition was heard for some time and an attempt, in the past, was made by this Court also to amicably resolve the issues between petitioner and respondent, Mr. Pandey and Mr. Sawant invited the Court to pass the following order by consent. Petitioner and respondent are present in Court and both also consent to disposing the petition and for the passing of the order as under. I have to also add that this is the stand that respondent had taken in its advocate's letter dated 26th November 2018. Therefore, by consent, the following order is passed :

(1) Respondent shall issue a Power of Attorney in favour of petitioner authorising petitioner to :

(a) open a savings bank account in the name of the minor Master Krishna Ashish Ahuja with petitioner being the sole signatory to operate the account. This Power of Attorney can also be used to open and operate any Fixed Deposit account or recurring deposit account with any bank. This Power of Attorney will be valid until 20th December 2026, since the minor will turn major on 19th December 2026, and will not be revoked without leave of the Court; Gauri Gaekwad

2/2 13.GP-32-2016.doc (b) sign all applications and forms required for academic pursuits of minor "Master Krishna Ashish Ahuja" including for school, high school, college, coaching classes or tuition classes, etc.;

(c) sign any form or application required for any trips or medical treatments for the minor Master Krishna Ashish Ahuja;

(2) respondent will also make himself available should the need arise to sign any form or application including passport applications in the name of the minor Master Krishna Ashish Ahuja.

(3) Respondent shall also attend the school of the minor should his presence be required during the Parents Teachers Association meeting or open day or the like;

(4) respondent shall continue to pay the monthly maintenance as per the interim order passed by the Magistrate Court at Andheri on 28th June 2018. Mr. Pandey states that as regards the access to minor by respondent is concerned, petitioner shall strictly comply with the consent terms filed in the Family Court.

The statements recorded above are accepted as undertakings to this Court.

Petition accordingly stands disposed.
