By this notice of motion, the applicant / petitioner seeks recall of the order dated 5th July, 2012 insofar as Testamentary Petition No.1041 of 2010 is concerned. Learned counsel for the applicant states that all office objections are already removed and the petition is ready for final notice. He submits that the objections are not removed by the petitioner due to the personal difficulties and undertakes to remove all the office objection, if already not removed within two weeks from today.

For the reasons recorded in the affidavit in support of the notice of motion and in view of the undertaking rendered by the learned counsel for the petitioner, the notice of motion is made 1/2

24-nmt22-17 absolute in terms of prayer clause (a) and (b) on the condition that the petitioner removes all the office objections, if any, within two weeks from today. It is made clear that no further extension would be granted.

If all the office objections are not removed within the time prescribed, the Testamentary Petition No.1041 of 2010 shall stand dismissed without further reference to the Court. (R.D. DHANUKA, J.) 2/2
