IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION COMPANY APPLICATION NO.181 OF 2017 IN COMPANY PETITION NO.159 OF 2009 Executive Engineer Maharashtra Jeevan Pradhikaran ....Applicant Vs.

The Official Liquidator of M/s. Astral Glass Pvt. Ltd. ....Respondent ---- Ms. Riba Vasudevan i/b. Ms. Neeta Karnik for applicant. Mr. Mahendhar Aithe, Company Prosecutor for Official Liquidator present. ---- CORAM : K.R.SHRIRAM, J.

DATE : 5th OCTOBER, 2017 P.C.:

The counsel for applicant refuses to go on with the matter though the matter is listed today for dismissal. Ms. Vasudevan, counsel for applicant states that the concerned Advocate is busy on her legs in another Court. Even on 27th September, 2017 the Advocate for applicant remained absent and hence the matter was listed today for dismissal. Strangely the Advocate does not consider it necessary to remain present in Court even if the matter is listed for dismissal and sent her junior, who refuses to go on with the matter. Nonetheless, this Court without assistance of the Advocate for applicant considered the affidavit in support of the application which is for condonation of delay of 181 days in filling the application filed by applicant before the Official Liquidator for adjudication of their claim.
