Heard learned Counsel for the parties. After the matter was heard on the earlier occasion and again today the learned Counsel for the parties inform that the parties have finally reached a consensus. They place on record consent terms as arrived between the parties, by which it is stated that the issues in the present petition under Section 9 of the Arbitration and Conciliation Act,1996, stand resolved. The consent terms are signed by the authorised signatory of the petitioner and on behalf of respondent no.1 - Municipal Council of Khamgaon by the Chief Officer Mr.D.R.Bordkar. The consent terms are also initialed by the Advocates for the respective parties. The consent terms are accordingly taken on record and marked "X" for identification.

The petition is disposed of in terms of the consent terms. The undertakings of the parties as appearing in various clauses stand accepted.

Needless to observe that all contentions of the parties in regard to all the issues on the contract in question are expressly kept open.
